2. Professional and Regulatory Information

Status and professional title

Maître Hervé Israel practises the profession of Avocat within the meaning of French Law n°71-1130 of 31 December 1971 reforming certain judicial and legal professions. Registered with the Paris Bar (Ordre des Avocats de Paris) since 1996, he is authorised to practise the profession of avocat throughout French territory and, in accordance with Directive 98/5/EC, in other Member States of the European Union under his home professional title.

In Dubai, Maître Hervé Israel practises as a Consultant from the Meydan Free Zone, in strict compliance with Federal Decree-Law No. 34 of 2022 regulating the legal profession and legal consultation profession in the United Arab Emirates and with the Code of Ethics adopted by Cabinet Resolution No. 9 of 2025.

Important notice: the title “Avocat” is a regulated French professional title. Use of this title in the UAE does not confer any right of audience before onshore UAE courts, which is reserved exclusively to advocates registered on the UAE Roll of Advocates pursuant to Federal Decree-Law No. 34 of 2022.

Scope of services

In the United Arab Emirates, Maître Hervé Israel provides exclusively services of legal advice on French law, European Union law and international law. Maître Hervé Israel is not authorised to plead before the onshore courts of the United Arab Emirates, such right being reserved to advocates registered on the UAE Roll of Advocates.

Applicable professional rules

The practice of the profession of avocat is governed in particular by:

  • French Law n°71-1130 of 31 December 1971;
  • French Decree n°91-1197 of 27 November 1991;
  • the Règlement Intérieur National(RIN) of the legal profession, available at cnb.avocat.fr;
  • the Règlement Intérieur du Barreau de Paris(RIBP), available at avocatparis.org;
  • the Code of Conduct for European Lawyers (CCBE), incorporated into the RIN.

The competent disciplinary authority is the Paris Bar Council (Ordre des Avocats de Paris) — 11 place Dauphine, 75001 Paris, France.

Professional indemnity insurance and financial guarantee

In accordance with Article 27 of the Law of 31 December 1971 and Articles 205 et seq. of the Decree of 27 November 1991, Maître Hervé Israel benefits from:

  • a professional indemnity insurancepolicy taken out by the Paris Bar. This coverage extends to services rendered worldwide;
  • a financial guaranteefor the representation of client funds (maniement de fonds through the CARPA), taken out for an unlimited amount.

Fees

In accordance with Article 11.1 of the RIN and Article 10 of the Law of 31 December 1971 (as amended by the Macron Law of 6 August 2015), the fees of Maître Hervé Israel  are freely agreed with the client, in compliance with applicable ethical rules, taking into account in particular the complexity of the matter, the time spent, the financial situation of the client, expenses incurred and professional reputation.

A written fee agreement is systematically entered into with each client prior to the commencement of any engagement, in accordance with Article 10 of the 1971 Law. This agreement specifies the method of fee calculation (fixed fee, hourly, mixed, or with a success-fee component within the limits permitted by Article 10), as well as foreseeable expenses and disbursements.

Standard fee arrangements: – Time-based fees – Fixed fees: by prior quote; – Success fees: only as a complement to time-based or fixed fees.

Consumer mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code and Article 21 of the Law of 18 November 2016, any consumer client has the right, in the event of a dispute with his avocat that has not been resolved amicably, to refer the matter free of charge to the Mediator for the consumer of the legal profession:

Anti-money laundering and counter-terrorism financing (AML/CFT)

In accordance with Articles L.561-1 et seq. of the French Monetary and Financial Code transposing the EU anti-money laundering directives, the ethical obligations imposed by the RIN, and, in the United Arab Emirates, Cabinet Decision No. 10 of 2019 and Federal Decree-Law No. 20 of 2018, Maître [First name LAST NAME] is subject to client identification and due diligence obligations (KYC) prior to entering into any business relationship. The completion of a full KYC file is a prerequisite to opening any engagement.
